End User License Agreement
1. Grant of License
Subject to the terms of this Agreement, Stefano Pretoni ("Licensor") grants you ("Licensee") a non-exclusive, non-transferable, limited license to install and use Fantago ("Software") on hardware owned or controlled by you, solely for your internal business or personal purposes.
- Demo License: The Software may be used free of charge with functional limitations. The Demo license is time-limited (60-day trial period followed by a 3-day grace period).
- Pro License: Upon purchase and activation of a valid Pro license key through the authorized reseller (LemonSqueezy), the functional limitations are removed. The Pro license is granted per installation and is tied to the hardware on which it is activated.
- You may not sublicense, sell, rent, lease, transfer, assign, or otherwise dispose of the Software or any license key.
Updates and Version Upgrade Policy:
- Updates within the same major version are included at no additional cost (e.g., all 2.x.x releases are covered by a v2 license).
- A new major release (e.g., version 3.0) constitutes a distinct product and requires the purchase of a new Pro license.
- Early adopter protection: If a new major release is published within sixty (60) calendar days of your Pro license purchase date, you are entitled to a complimentary upgrade. Contact info@fantago.com within 30 days of the new major release publication date with proof of original purchase.
- Loyalty discount: Users who hold, or have previously held, a valid Pro license for any prior major version are entitled to purchase a new major release at a preferential price.
2. Intellectual Property
The Software is licensed, not sold. Stefano Pretoni retains all intellectual property rights in and to the Software, including all source code, algorithms, interfaces, design, structure, and documentation.
Any feedback or suggestions you communicate to the Licensor are considered a voluntary contribution. The Licensor shall have the unrestricted right to use and incorporate such contributions without any obligation of attribution or compensation.
3. Restrictions
You may not, and you may not permit others to:
- Copy, modify, translate, adapt, or create derivative works of the Software;
- Reverse engineer, disassemble, decompile, or otherwise attempt to derive the source code;
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices;
- Circumvent or disable any licensing, activation, or copy-protection mechanisms;
- Use the Software for any unlawful purpose or in violation of applicable laws;
- Distribute, publish, or make available the Software or any license key to third parties.
4. Third-Party Hardware, Device Handlers, and Trademarks
Fantago includes components ("Handlers") that enable communication with third-party hardware devices. Handlers are provided as-is. Device manufacturers may change protocols at any time; the Licensor is not responsible for resulting incompatibilities. The Licensee is solely responsible for verifying compatibility before deploying in a production environment.
Some advanced integrations may rely on network communication capabilities available on supported devices. Compatibility may change with future firmware or software updates by the respective manufacturer. The Licensor does not guarantee continued compatibility and accepts no liability for any disruption caused by third-party updates.
Third-Party Trademark Notice: All product names, logos, and trademarks mentioned in this software or its documentation are the property of their respective owners. In particular: Stream Deck and Stream Deck Studio are trademarks of Elgato Gaming GmbH, a subsidiary of Corsair Gaming, Inc. Fantago is an independent product and is not affiliated with, endorsed by, sponsored by, or certified by Elgato or Corsair in any way. Dante, Audinate, Dante Controller, Dante Virtual Soundcard, and Dante Domain Manager are trademarks or registered trademarks of Audinate Pty Ltd; Fantago is not affiliated with, endorsed by, sponsored by, or certified by Audinate, and its Dante integration is neither a Dante-certified nor a Dante-licensed product. Any reference to these trademarks is solely for the purpose of identifying the compatible hardware and describing interoperability.
5. Community Plugin Contributions
The Fantago platform exposes a plugin API ("Custom Handlers") that allows developers to create and submit device integration plugins for potential inclusion in the official Fantago distribution. If you choose to submit a Custom Handler to the Licensor, the following terms apply:
- a) Ownership: You retain full copyright ownership of your submitted plugin code.
- b) License Grant: By submitting a plugin, you grant Stefano Pretoni a perpetual, worldwide, royalty-free, non-exclusive license to use, reproduce, modify for compatibility, distribute, and publish your plugin as part of the Fantago software and on the Fantago website, free of charge to end users.
- c) Open Source: Accepted community plugins will be made publicly available under the MIT License, allowing any Fantago user to download, use, and modify them freely.
- d) Attribution: The Licensor commits to crediting the original author by name in the plugin metadata (the "author" field) and in any public listing on the Fantago website, preserving full attribution for the entire duration of publication.
- e) Review and Discretion: Submission does not guarantee publication. The Licensor reserves the right to review, decline, or later remove any submitted plugin at its sole discretion and without obligation to provide reasons.
- f) Author Warranties: By submitting, you represent that you are the sole original author of the submitted code, that it does not infringe any third-party intellectual property rights, and that it does not contain malicious, harmful, or unlawful code.
- g) No Compensation: Plugin contributions are entirely voluntary. No financial compensation, license fee, or royalty of any kind will be paid for accepted or published submissions.
6. AI Assistant Features (Beta)
Fantago includes an integrated AI assistant ("AI Features"). By enabling or using the AI Features, you acknowledge and agree to the following terms:
- a) Beta Status: The AI Features are released as BETA functionality. They are not fully tested and remain under active development. They may contain bugs, produce incorrect or unexpected results, and are subject to change or removal without notice. Use of the AI Features in live or critical production environments is undertaken entirely at your own risk.
- b) Third-Party AI Providers: The AI Features operate by sending data (including device names, command structures, handler code, and natural-language instructions) to the third-party AI service provider you configure in the application settings. You access these services using your own credentials (API keys or accounts). The Licensor has no visibility into, control over, or responsibility for the processing of your data by any third-party AI provider. You are solely responsible for reviewing and accepting the terms of service and privacy policies of your chosen AI provider.
- c) Data Responsibility: Any data transmitted to an AI provider — including potentially sensitive operational information — is transmitted solely on the basis of your configuration choices. The Licensor accepts no liability for data handled by third-party AI services.
- d) Costs: Use of commercial AI models (such as OpenAI, Anthropic Claude, Google Gemini paid tiers, or any other provider that charges per request or token) may incur fees. All such fees, of any amount, are entirely your own responsibility. The Licensor does not bear any cost arising from your use of third-party AI services, regardless of volume or circumstance.
- e) Local AI Models: The AI Features are also compatible with locally-hosted AI models via software such as Ollama or similar OpenAI-compatible endpoints. Local models operate entirely offline at no cost and without transmitting data to external servers. However, the capabilities and output quality of local models are significantly inferior to those of leading cloud-based models. Certain tasks — in particular the generation of Advanced handler plugins — may produce incomplete, incorrect, or non-functional results when performed with a local model. The Licensor makes no warranty regarding the suitability of any specific local model for any particular task.
- f) No AI Warranty: The Licensor provides no warranty, express or implied, regarding the accuracy, completeness, fitness for purpose, or reliability of any output generated by the AI Features. AI-generated content (including device handlers, automation flows, and commands) must be reviewed and validated by the user before deployment.
7. Disclaimer of Warranties
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSOR EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
8. Demo License and Pre-Purchase Evaluation
Fantago is available free of charge in Demo mode for 60 days from first installation, followed by a 3-day grace period. By purchasing a Pro license, you acknowledge that you have had the opportunity to evaluate the Software during the Demo period and have verified its suitability for your requirements.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, BROADCAST INTERRUPTIONS, OR HARDWARE DAMAGE.
The Licensor's total aggregate liability shall not exceed the amount actually paid by you for the Software in the twelve (12) months preceding the claim. Any claim must be formally initiated within six (6) months from the date you became aware of the facts giving rise to it.
10. Use in Critical and Live Production Environments
You are solely responsible for testing the Software before deploying it in any live or critical production environment. The Licensor strongly recommends maintaining backup control systems. The Licensor shall not be liable for any on-air errors or broadcast interruptions.
11. Privacy and Data
Network communication is limited to:
- License activation: transmits your license key and a hardware identifier to LemonSqueezy for one-time validation.
- License deactivation: transmits your instance ID to LemonSqueezy to release the activation slot, if you choose to deactivate.
- Update checks: transmits the current software version only. No installation data is sent.
- Anonymous usage telemetry (opt-out): once every 24 hours, the Software transmits a small anonymous ping to fantago.com containing: app version, operating system platform, license type (Demo or Pro), and an anonymous installation ID — a one-way SHA-256 hash of your hardware identifier that cannot be reversed or linked to your identity. Your IP address is used at the moment of the ping solely to derive the approximate country and city of the installation for geographic statistics; the IP address is immediately discarded and never stored. For Pro users, a one-way SHA-256 hash of the license key is also included to enable accurate cross-machine statistics when a license is migrated to a new computer; the license key itself is never transmitted or stored in plain form. Telemetry data is stored on servers in the European Union (Italy) and records for inactive installations are automatically purged after 24 months. This feature is enabled by default and can be disabled at any time via Settings → Privacy.
- AI Features: transmits data to the AI provider you configure, as described in Section 6.
The legal basis for processing telemetry data is legitimate interest (Art. 6.1.f GDPR): understanding version adoption and geographic distribution to improve the product. You may opt out at any time without consequence. See also our Privacy Policy.
12. Term and Termination
This Agreement is effective from the date of first installation. It terminates automatically if you fail to comply with its terms, or upon your uninstalling the Software and destroying all copies.
13. Governing Law
This Agreement shall be governed by the laws of Italy. Any dispute shall be subject to the exclusive jurisdiction of the courts of Italy.
14. General Provisions
- Entire Agreement: This Agreement supersedes all prior understandings.
- Severability: If any provision is unenforceable, the remaining provisions remain in full force.
- No Waiver: Failure to enforce any provision does not waive future enforcement.
- Updates: Continued use after an update constitutes acceptance of the revised terms.
